Terms of Service

These Terms of Service ("Terms") govern your access to and use of PlumbQuote CA (the "Service"), a software application available at plumbquote.ca. The Service is operated by Clezil da Silva, a sole proprietor based in British Columbia, Canada ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

PlumbQuote CA is a cost-estimation tool designed to help plumbing professionals prepare price estimates for their own clients. The Service generates estimates based on user inputs and reference market data. These estimates are not quotes, bids, or binding prices.

Important: All figures produced by the Service are estimates only. You are solely responsible for the final prices you charge your own clients, for verifying material and labour costs with your suppliers, and for complying with all applicable codes and regulations. We do not guarantee the accuracy of any estimate.

2. Accounts and Eligibility

To use the Service you must register an account with a valid name, email, and mobile phone number, and verify your phone number by SMS. You are responsible for keeping your login credentials secure and for all activity under your account. One phone number may be linked to one account (except where Team plan members are added by an account owner).

3. Subscriptions, Billing and Renewal

The Service offers paid subscription plans (Trainee, Pro, and Team) billed monthly or annually through our payment processor, Stripe. By subscribing you authorize us to charge your payment method on a recurring basis.

Automatic renewal: All subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel.
Free trial: New users receive a 5-day free trial with full access. If you do not subscribe before the trial ends, your access is restricted until you choose a paid plan.

4. Cancellation and Refunds

Please read carefully: You may cancel your subscription at any time. When you cancel, you will continue to have access until the end of the period you have already paid for. We do not provide refunds for any partial or unused periods, including annual plans paid in advance. Cancelling an annual plan stops future renewals but does not refund the remaining months.

To cancel, use the "Manage Subscription" option in your account settings, which opens the Stripe customer portal.

5. Acceptable Use

You agree not to misuse the Service, including by attempting to access it through unauthorized means, reselling access without permission, or using it for any unlawful purpose.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will match actual market prices.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, arising from your use of the Service or reliance on any estimate it produces. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
